STATE COLLEGE — Penn State’s Board of Trustees is facing another transparency challenge in federal court. Spotlight PA reports 3 news organizations are suing board leaders over trustee communication rules.
The lawsuit says board bylaws unconstitutionally restrict what individual trustees may say publicly. Spotlight PA, the Centre Daily Times, and StateCollege.com say the rules limit criticism of the board or university.
The lawsuit also says trustees must get approval before speaking with reporters. The news organizations say that creates a chilling effect on public discussion.
Penn State officials tell Spotlight PA the university does not comment on pending litigation. The lawsuit asks a federal judge to declare the restrictions unconstitutional.
